A prote\u00e7\u00e3o conferida pela patente \u00e9, portanto, um valioso e imprescind\u00edvel instrumento para que a inven\u00e7\u00e3o e a cria\u00e7\u00e3o industrializ\u00e1vel se torne um investimento rent\u00e1vel.<\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">Patente \u00e9 um t\u00edtulo de propriedade tempor\u00e1ria sobre uma inven\u00e7\u00e3o ou modelo de utilidade, outorgados pelo Estado aos inventores ou autores ou outras pessoas f\u00edsicas ou jur\u00eddicas detentoras de direitos sobre a cria\u00e7\u00e3o. Em contrapartida, o inventor se obriga a revelar detalhadamente todo o conte\u00fado t\u00e9cnico da mat\u00e9ria protegida pela patente.<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">Durante o prazo de vig\u00eancia da patente, o titular tem o direito de excluir terceiros, sem sua pr\u00e9via autoriza\u00e7\u00e3o, de atos relativos \u00e0 mat\u00e9ria protegida, tais como fabrica\u00e7\u00e3o, comercializa\u00e7\u00e3o, importa\u00e7\u00e3o, uso, venda, etc.<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">Dep\u00f3sito e Conte\u00fado do Pedido de Patente<\/span><\/p><p>O dep\u00f3sito do pedido de patente pode ser efetuado no INPI \u2013 Instituto Nacional da Propriedade Industrial.<\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">Os pedidos dever\u00e3o ser solicitados atrav\u00e9s de formul\u00e1rios espec\u00edficos, (Dep\u00f3sito de Pedido de Patente ou de Certificado de Adi\u00e7\u00e3o ou o de Modelo de Utilidade).<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">O INPI exige que a documenta\u00e7\u00e3o seja apresentada em 3 (tr\u00eas) vias, devendo o depositante, se desejar, apresentar mais 2 (duas) vias para uso pr\u00f3prio. Descri\u00e7\u00e3o do estado da t\u00e9cnica: \u00e9 a mat\u00e9ria que poder\u00e1 ser \u00fatil para facilitar a compreens\u00e3o da inven\u00e7\u00e3o e, sempre que for poss\u00edvel, devem ser citados os documentos (patentes ou qualquer outra fonte bibliogr\u00e1fica) que possam aumentar o conte\u00fado informativo.<\/span><\/p>\n<p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">4. Descri\u00e7\u00e3o dos pontos deficientes do estado do t\u00e9cnica: s\u00e3o os pontos deficientes do estado da t\u00e9cnica.<\/span><\/p>\n<p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">5. Definir os objetivos da inven\u00e7\u00e3o: mencionar a maneira pela qual a inven\u00e7\u00e3o soluciona os problemas encontrados no estado da t\u00e9cnica, destacar as vantagens da solu\u00e7\u00e3o proposta abordando o conte\u00fado inventivo, ou seja, destacando nitidamente o requisito de novidade e o efeito t\u00e9cnico alcan\u00e7ado (atividade inventiva).<\/span><\/p>\n<p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">6. Relacionar as figuras nos desenhos: especificar suas representa\u00e7\u00f5es gr\u00e1ficas (vistas, cortes, fluxogramas,\u2026). Especificar, nos casos em que houve inclus\u00e3o de reprodu\u00e7\u00e3o de fotografias, as caracter\u00edsticas peculiares a esse tipo de representa\u00e7\u00e3o gr\u00e1fica (amplia\u00e7\u00e3o, condi\u00e7\u00f5es e natureza do material fotogr\u00e1fico,\u2026).<\/span><\/p>\n<p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">7. Descri\u00e7\u00e3o detalhada da inven\u00e7\u00e3o: descrever a inven\u00e7\u00e3o detalhando suas caracter\u00edsticas de modo que haja uma perfeita compreens\u00e3o da mesma por um t\u00e9cnico no assunto, de tal modo que o mesmo possa reproduzi-la, fazendo remiss\u00e3o aos sinais de refer\u00eancia constantes dos desenhos, se houver, e, se necess\u00e1rio, utilizar exemplos e\/ou quadros comparativos relacionando-os com o estado da t\u00e9cnica. Ressaltar a melhor forma de execu\u00e7\u00e3o da inven\u00e7\u00e3o, em caso de haver mais de uma forma que seja do conhecimento do depositante na data de dep\u00f3sito e apontar a utiliza\u00e7\u00e3o industrial quando esta n\u00e3o estiver expl\u00edcita na descri\u00e7\u00e3o da inven\u00e7\u00e3o.<\/span><\/p>\n<p><br><\/p>\n<p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">Resumo:<\/span><\/p>\n<p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">Sum\u00e1rio do exposto no relat\u00f3rio descritivo, reivindica\u00e7\u00f5es e desenhos (50 a 200 palavras, preferentemente 20 linhas de texto). Estar a par do desenvolvimento da tecnologia , uma vez que a informa\u00e7\u00e3o das t\u00e9cnicas mais utilizadas evita a obten\u00e7\u00e3o de uma patente obsoleta; o conhecimento das novidades introduzidas na t\u00e9cnica permite maior clareza da mat\u00e9ria nova e delimita a \u00e1rea da inven\u00e7\u00e3o e os efeitos t\u00e9cnicos introduzidos;<\/span><\/p><p><span style=\"font-family: var( --e-global-typography-text-font-family ); font-weight: var( --e-global-typography-text-font-weight );\">3.
